If you and your co-workers are members of a union, your employer is required by law to bargain in good faith with the union. This means that the employer must be prepared to make improvements, otherwise the union will ask your provincial labour authority to intervene. While the legal environment in Quebec differs considerably in many respects, most provincial and federal laws follow the standard of business-based fee structures. They also share a certification process (the details of which vary slightly from province to province) whereby unions recognize by the state that they have the support of a majority of workers in a narrowly defined workplace. Section 32 (1) If two or more unions have formed a union council, the board so constituted may apply to the executive committee to be certified as a negotiator of a unit in the same manner as a union. In general, unions are organizations made up of workers in a particular trade, such as autoworkers or teachers. Finally, unions help workers by making sure they have enough hours to get a good paycheque, shifts that fit their schedule, and good performance that can help workers and their families lead healthy lives. (2) The Board may certify a union council as a bargaining unit negotiator if it is satisfied that the certification requirements prescribed in or under this Part are met. If negotiations do not result in a new or first collective agreement, members may vote in favour of a strike. During strikes, workers suspend their work to pressure the employer to negotiate a fair contract. A legal strike can only take place if a union agreement is not in force – if negotiations on the renewal of an agreement are stalled or if no initial agreement can be reached. Strikes are rare and are the last resort for workers who need to draw the employer`s attention to their needs.

Unions empower workers by helping their members work together for better wages, fair benefits, safe and healthy workplaces and stable working hours. Unions also help workers gain more rights and power in the workplace – and have a greater say in their working conditions – by acting as checks and balances to management. In addition, unions help strengthen communities by attracting higher wages and benefits for members, who are then invested in the local economy. Injustice does exist in the workplace, especially in non-unionized workplaces. Many people lack respect and dignity in the workplace, and their work environment makes them unhappy. But when workers come together to join a union, they are able to overcome this sense of powerlessness and helplessness. Often, it is only when workers join a union that they realize that the myths they once believed about unions are just myths. UFCW Canada, like other unions, tries to avoid strikes because the impact on both parties can be severe and lasting. In fact, more than 95% of our collective agreements are conducted without strikes or lockouts. For union members, a strike means hardship for them and their families.

Union members will not strike if the issues at stake are not so important as to be worth the sacrifice.
