The usual practice of exceptionally awarding damages and granting a certain benefit was abolished with the enactment of the Specific Remedies (Amendment) Act 2018. This amendment gave the courts greater discretion in the provision of a particular service and made specific performance of the contract a general rule rather than an exception subject to certain limited reasons. In addition, the amendment also provides for the performance of the replacement contract and allows the courts to consult with experts on certain matters.
