You actually have more consumer protection when you buy online. If you`re buying from an EU-based company (including those that sell through eBay), you have the legal right to cancel the order and then an additional 14 days to return the goods for a full refund – even if you just don`t want them. If you use PayPal to pay for goods online for main street stores, you can get a refund through the retailer or PayPal itself. If a retail seller sells certain products under a return policy that meets these general expectations, but sells other goods under a different return policy, the seller must meet the visible display requirement for those products. When purchasing a gift, consumers should follow the store`s policies regarding refunds, discounts, and rain checks. The Ministry of Consumer Protection offers these tips to inform and empower consumers. REFUNDS A store is required by law to publish its refund policy. If the store does not publish a return policy, the law requires the store to accept your return within 30 days of purchase. New York law does not require a store to offer a refund in the form of cash, credit, substitutes, or other means. Retailers must provide a written copy of the store`s available refund policy and disclose any charges associated with the return. DISCOUNT Any advertisement that includes a discount must clearly (1) indicate the actual selling price and indicate that a discount by mail is required to obtain a lower advertised net discount; and (2) communicate to consumers how the discount will be returned to the consumer, either by cheque, gift card or future purchase credit; and (3) if the consumer incurs additional costs to redeem such discounts.

The RAINCHECKS NYS Act does not currently regulate the provision of rain checks. SUGGESTED STEPS TO TAKE AND ASK QUESTIONS Almost all consumers have returned an item purchased at retail for a refund, exchange or credit. While merchants are only required to accept returns in certain situations, some states have laws that govern the disclosure of refund and return policies. In addition to applicable federal laws, many states have laws regarding consumer refunds. Often, refund policies must be clearly visible at the point of purchase to be valid. Many states, in addition to the protections of the federal think tank rule, allow consumers to cancel their club membership or other special purchase agreements within a certain number of business days. This applies in particular if all sales are considered a final sale and the goods cannot be returned. A retail seller who violates the requirements of § 1723 of the Civil Code is liable to the customer for the amount of the purchase. The Seller may also be held liable to the Customer under the Consumer Remedies Act (Civil Code §§ 1750-1784). This law provides for additional remedies such as actual damages and injunctive relief for unfair or deceptive acts in the sale of goods to consumers. Online shoppers should check a merchant`s website to determine if returns are allowed and, if so, what a consumer must do to return an item. If the information is not published on the store`s website, you should be careful when making your purchase. If you decide to continue, you must first contact the dealer and request the return information in writing. In both cases, be sure to print and keep the return information (as well as all receipts, packing slips, and other documents). According to Thomas Pertaia, a lawyer at DAS Law, if you have ordered goods from suppliers outside the UK and received the wrong item or if the item was defective, you have the right to request a repair or replacement.

The FTC also applies a “think tank rule” that applies exclusively to door-to-door sales. It gives the consumer three (3) days to cancel purchases of $25 or more made at home, at work or in a person`s dormitory, or in facilities rented by the seller on a short-term basis, such as: Hotel or motel rooms, convention centers, exhibition center and restaurants.
